The owner of this Site, assumes no responsibility or liability for any consequence resulting directly or indirectly from any action or inaction you take based on the information found on or material linked to on this Site. Any information on this Site is provided for promotional or informational purposes only and is not to be relied upon as a professional or medcal opinion. By using this Site, you accept and agree that following and using any information or recommendations provided on this Site is at your own risk.

Please read carefully! Your access to and use of this Site is subject to legally binding terms and conditions which you accept and agree to by accessing this Site. The following terms and conditions form a binding agreement (this “Agreement”) between you and Mystica Tribu and its founders.

Mystica Tribu may modify, amend, supplement and replace these terms and conditions at any time without providing you with advance notice. Your continued use of this Site after any change means you have accepted the changed terms and conditions.

1. Links to Third-Party Websites. This Site may contain links to third-party websites. All such linked sites, materials and pages are not under the control of Mystica Tribu and they are not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any third-party website.

Mystica Tribu accepts no liability for any errors or omissions contained in third-party websites. These links are provided to improve your use of this Site, enable you to connect with Mystica Tribu on various platforms, help Mystica Tribu offer the easiest services for you and conduct transactions.

1. Use License. a. The materials found on the Site are for non-commercial viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: a. modify or copy the materials; b. use the materials for any commercial purpose or for any public display (commercial or non-commercial); c. transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Mystica Tribu at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
2. Refunds for online services, phone / zoom calls and courses. There will be no refunds for any deposits or payments made to Mystica Tribu and its founders for any online services, phone / Facetime / Zoom call services, events or online courses sold on or through the Site. All sales of this type are final.
3. Entire Agreement. These terms and conditions and any other legal notices, policies and guidelines of Mystica Tribu linked to these terms and conditions or contained on this Site constitute the entire agreement between you and Mystica Tribu relating to your use of this Site and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter. This Agreement may not be amended or modified except by Mystica Tribu
4. Site Terms of Use Modifications. Mystica Tribu may revise these terms of use for its website at any time without notice. By continuing to use the Site after Mystica Tribu modifies this Agreement, you are agreeing to be bound by this updated version of this Agreement.
5. Limitation of Liability. In no event shall Mystica Tribu or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to view or use the materials or content on Site, even if Mystica Tribu has been notified orally or in writing of the possibility of such damage.
6. Indemnity. As a condition of your use of this Site, you indemnify Mystica Tribu, its founders and its partners from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting or arising from your use of this Site.

ALCHEMY RETREAT TERMS & CONDITIONS 

PREPARATION & RESTRICTIONS
All Participants should consult their physician regarding their physical fitness level, mental status and any other special conditions they may be working with. It is the Participant’s responsibility to assess the risks and requirements of the program.

Before the beginning of the retreat the participant must disclose any known medical conditions and/or the use of any prescription or non-prescription medication or supplements during their pre-registration

All participants agree that they are participating at their own risk and that Mystica Tribu, its founders, the Alchemist Retreat, the Alchemist Retreat Team, and their Facilitators do not accept liability for any accident or injury to their person.

DEPOSITS AND CANCELLATION POLICY
The 50% NON-REFUNDABLE deposit is due upon enrolment to hold your spot. Full payment is required 30 days before the start of the program unless a payment plan has been previously arranged.

All paid deposits and funds are non-refundable and for any cancellations outside of 30 days prior to event, funds can be used for future offerings within 12 months. Cancellations within 30 days prior to event are non-transferable and non-refundable.

Once the Retreat begins the program fee is non-refundable and non-transferable. On the rare occasions when the Alchemy Retreat Team (“ART”) needs to cancel the Retreat, a refund will be provided, however, ART is not responsible for any costs incurred for travel arrangements or accommodations related to any event. It is your responsibility to purchase travel insurance to protect yourself from any loss due to program cancellations, changes or weather delays. We will not, under any circumstance, reimburse you for airfare or ground transfer expenses.

If ART needs to cancel the retreat due to an unlikely event of extreme weather conditions, natural disaster, pandemic lockdown, or national security threat then you will receive a 50% refund on the initial amount paid.

CODES OF CONDUCT
Participants understand that by registering for the Alchemist Retreat, they certify that they understand that the ART and Facilitators reserve the right to expel any participant from the Retreat; to make changes to the program whenever the ART and Facilitators deem it necessary for the comfort, convenience, or safety of the Participants.

Participants must be at least 18 years old to take the Retreat. They agree that Alchemist Retreat Team (ART) reserves the right at any time to ask any guest to leave the Retreat if the and ART and facilitator feels that they pose a risk to the physical safety of the facilitator or other Participants or if they are compromising the learning and healing process of the group, if their behavior is disruptive, inappropriate, unethical or violates ethical guidelines.

Under such circumstances, they agree that they will not be refunded any part of their fees. Participants also agree that they are responsible for assessing their own suitability and capability to participate in the Retreat.

RELEASE & WAIVER OF LIABILITY
Alchemist Retreat Team reserves the right to change, alter, or amend the daily itinerary/schedule for each Retreat at any time. Assumption of Risk, and Indemnity Agreement. Participants agree that ART is here to serve them by sharing knowledge of healing modalities, including but not limited to breathwork, qi gong, meditation, sound therapy, ceremonies, hiking and any related activities to promote exercise and good mental and physical health (“Healing Modalities”).

In connection with their participation in the healing modalities, they understand, acknowledge and agree as follows: Participation in the Healing Modalities and Ceremonies is completely voluntary and it is solely their decision to participate in such activities. The practice of certain healing modalities involves physical movement and breathing exercises which may from time to time be strenuous, and that such practice carries some risk of injury.

Participants declare to be qualified, in good health and in proper physical condition to participate in the Healing Modalities and Ceremonies. They understand that they must judge their own capabilities with respect to participating in the healing modalities at the Alchemy Retreat and will only participate in the appropriate level of classes that are within my limits and capabilities.

Participants agree that it is their sole responsibility to confirm that there is no medical or other reason preventing them from participating in the Healing Modalities and Ceremonies.

If they are pregnant, they shall only participate in the Healing Modalities after they have discussed the potential risks with their obstetrician. They must follow their obstetrician’s advice and instructions about whether and to what extent they can participate in the Healing Modalities. They agree that they (and their spouse/partner, heirs, and guardians) will hold Releasees harmless for any possible injury to myself, my spouse/partner, heirs, guardians and/or my child/fetus.

If participants believe any conditions are unsafe, they will immediately discontinue participation in the Healing Modalities and Ceremony. It is their responsibility to inform the Facilitators immediately if an injury occurs in connection with the Healing Modalities. From time to time during Healing Modalities, instructors may physically adjust a participant form.

If they do not want such physical adjustments, they must inform the instructor at the beginning of each session that they attend. They also acknowledge that if they do wish to receive such physical adjustments, it is their responsibility to inform the instructor when they believe an adjustment has gone as far as they desire at that time.

That participation in Healing Modalities and Ceremonies involves risks of serious bodily injury and possibly death, which may be caused by the Participant’s own actions or inactions or those of others participating in the Healing Modalities. Participants must declare that they are voluntarily participating in the Healing Modalities and Ceremonies with full knowledge of the dangers involved and hereby agree to accept full responsibility for any/ all injury or death, including without limitation, personal, bodily or mental injury, economic loss or any damage that they suffer resulting from the acts of anyone at, or acting on behalf of ART.

As consideration for participants being permitted to participate in the Healing Modalities and Ceremonies, they (and their spouse/partner, heirs, and legal representatives) release ART and all its founders, facilitators, team members, parent companies, subsidiaries, affiliates and assigns and each of their predecessor and successor organizations and each of their current and former principals, instructors, partners, officers, directors, employees, insurers, agents and representatives and the owners/lessors of the premises wherein the Healing Modalities and Ceremonies take place (“Releasees”) from any and all liability and claims for damages arising out of, relating to and/or by reason of my voluntary decision to participate in the Healing Modalities and Ceremonies including the use of any equipment or the facilities.

Participants further agree that they (and their spouse/partner, heirs, and legal representatives) will not make a claim against, sue, or attach the property of ART or Releases for injury or damage resulting from the negligence, misconduct or other acts or omissions, howsoever caused, by any employee, agent, or contractor of ART as a result of their participation in the Healing Modalities and Ceremonies.

If any participants, or anyone acting on their behalf, make a claim against any of the Releases, they will indemnify, save and hold harmless each of the Releases from any loss, liability, damage or costs which may incur as a result of such claim. In connection with my participation in the Healing Modalities, participants agree to abide by any reasonable rules and policies of Alchemist Retreat.

The Alchemist Retreat Team reserves the right to deny an individual’s participation in the Healing Modalities and Ceremonies based upon legitimate reasons such as an individual’s failure to follow any specified procedures.
